2. Service Description

AgileHR.io offers a comprehensive platform for:

• Skills assessment and team development.

• Goal-setting for personal growth and development.

• Setting deadlines for goal achievement.

• Progress tracking in skills development through visual charts.

• Skills gap analysis to identify strengths and weaknesses at both individual and team levels.

• Managing a skills database, including creating and editing skills.

• Creating users and teams for assessments.

• Self-assessment and team-wide assessments.

3. Conclusion of Contract and Trial Period

AgileHR.io offers a free trial period for new users, allowing access to the platform for a limited period. After the trial, a paid subscription is required to continue using the services. By registering an account and agreeing to these terms, the user acknowledges that any use beyond the trial period will be subject to fees.

4. Service Availability and Response Times

AgileHR.io ensures an annual uptime of 99.6%, excluding maintenance or force majeure events. Planned maintenance will be communicated 24 hours in advance. Users are encouraged to report malfunctions immediately to enable timely resolution, and AgileHR.io will aim to respond to critical issues within 4 hours during business hours.

5. Customer Obligations

Users are responsible for:

• Providing accurate and up-to-date information.

• Ensuring their internet connection meets the platform’s requirements.

• Securing their accounts using strong passwords.

• Notifying AgileHR.io of any unauthorized access or security breaches.

• Complying with applicable laws when using the platform.

6. Data Protection and Confidentiality

AgileHR.io respects user privacy and protects all data according to the applicable laws. Users' data is only accessible to authorized personnel and is not shared without consent, except as required by law. Both parties agree to keep all confidential information private and only use it for contractually agreed purposes.

7. Granting of Rights

AgileHR.io grants users a non-exclusive, non-transferable right to use the software during the term of the contract. Any third-party integrations are subject to their respective terms, and users may not sublicense or make the software available to third parties.

8. Prices, Payment Methods, and Terms of Payment

Subscription fees are charged based on the selected service package and any additional functionalities. Payments are due in advance and may be billed monthly, quarterly, or annually. Payment methods include bank transfer and credit card, and any failure to pay may result in account suspension.

9. Termination

Either party may terminate the contract by providing written notice three months before the end of the current billing period. AgileHR.io reserves the right to terminate accounts for non-payment or breach of terms. Upon termination, the user’s access to the platform will be revoked.

10. Limitation of Liability

AgileHR.io is not liable for any indirect, incidental, or consequential damages arising from the use of its platform, including but not limited to lost profits, data loss, or system downtime. The total liability is limited to the amount paid by the user for the service.

11. Changes to Terms

AgileHR.io reserves the right to amend these Terms & Conditions at any time. Any changes will be communicated to users in advance, and continued use of the platform will constitute acceptance of the updated terms.

12. Governing Law

These Terms & Conditions are governed by the laws of Portugal, and any disputes arising out of these terms shall be settled in the courts of Lisbon.
